SPECIAL TOWN MEETING OF THE ELECTORS
NOVEMBER 12, 2008

 

The Town of Cooks Valley Chairman Ron Fanetti called the special meeting to order at 8:45 pm on November 12, 2008.  Elected officials present were Ron Fanetti, Gary Yakesh, David Clements, Victoria Trinko, and Eunice Steinmetz.  See attached list for number of constituents present.

Gary Yakesh made a motion to accept and place on file the minutes of the special meeting of electors of November 28, 2007.  David Clements seconded the motion.  The motion passed 32-0. 

David Clements made a motion to accept the town tax levy of $139,000.00 to be paid in 2009 pursuant to Section 60.10 (1) (a) actually 60.12 (3) of Wisconsin statutes with a mil rate of .003111099. Vernon Steinmetz seconded the motion.  The motion passed 32-0.

Gary Yakesh made a motion to approve the 2009 highway expenditures pursuant to Section 81.01 (3) actually 82.01 of Wisconsin Statures not to exceed $180,000.  David Clements seconded the motion.  The motion passed 32-0.

Ron Fanetti made a motion to adjourn.  Gary Yakesh seconded the motion.  Clarence Shakal informed the board that a special meeting is the same as an annual meeting and therefore the board should ask the delegation if there was any further business.   David LaGesse stated that people had asked him to bring up the issue of village powers.  There was discussion about the ramifications of rescinding village powers.  Glenn Sarauer made a motion to take away village powers.  Robby Turner seconded the motion.  The vote was to be by secret paper vote.  The vote was 18 yes to take away village powers and 10 no to take away village powers. 
Ron Fanetti made a motion to adjourn the meeting at 9:09 pm.  Vernon Steinmetz seconded the motion.  The motion passed 31-0.

 

(Upon consultation with W.T.A. attorney and the Town of Cooks Valley attorney, this motion concerning the rescinding of village powers was invalid as the issue of rescinding village powers was not properly noticed as in being placed on the agenda.  A special meeting may address the same issues that are addressed in an annual meeting, however, a special meeting must state the time, date, location and purpose of the special meeting.  Only those items or purposes placed or stated may have action taken on them. )
