Chairman Ron Fanetti called the meeting to order on January 12, 2009 at 7:30 pm. The supervisors present were: David Clements and Gary Yakesh. Delegation present were: Victoria Trinko-clerk, Eunice Steinmetz-treasurer, and see the attached attendance sheet for residents attending the meeting.
PUBLIC COMMENT: Gary Yakesh presented a notice published in the IRS bulletin 2008-131 DTD where the mileage rate was stated for 2008 and 2009. The standard mileage rate beginning on Jan. 1, 2009 for the use of a car (also vans, pickups or panel trucks) will be: 55 cents per mile for business miles driven.
Gary Yakesh made a motion to approve and place on file the minutes of December 8, 2008 and the minutes of the special town board meeting and public hearing on December 17, 2008. David Clements seconded the motion. The motion carried 3-0.

David Clements made a motion to approve the December bills. Gary Yakesh seconded the motion. The motion carried 3-0.
Discussion and possible action on budget categories was postponed until the next monthly meeting.
Changes to the building permit ordinance were postponed until the next regular town board meeting.
Discussion and possible action on expanding the number of members on the plan commission was postponed until the next regular town board meeting. The board is postponing action on this item until the ordinance is in order and information is received from the town’s lawyer and WTA. Extension of the deadline for a Land Comprehensive plan may be available if the township is actively working on a plan.
In discussion about the current mining moratorium, it was the consensus of the board to let the moratorium expire on the three month date of January 13, 2009.
David Clements made a motion to charge .05 per copy of records for residents of the town of Cooks Valley and .25 per copy of records for non-residents of the township. Gary Yakesh seconded the motion. The motion carried 3-0.
Jon Benoy, claims adjuster for Rural Insurance, requested the town board to send out a Notice of Disallowance to the seven people who filed a Notice of Claim and Claim against the township on October 8, 2008 and copies of the Notices of Disallowance be sent to Attorney Thiel who filed the claim on their behalf. Jon Benoy provided the form for the Notice of Disallowance. He requested the letters be sent certified mail with the addressee required to sign for the letter. He also requested a copy of the letters sent to each claimant and their lawyer and a copy of the receipts that were delivered, signed and returned to the clerk. Gary Yakesh made a motion to send a Notice of Disallowance to Loran Zwiefelhofer, Glenn Sarauer, Jeff Buchner, Donald Prill, Sam LaGesse, Bill Schindler, Geraldine Robinson and copies sent to Attorney William G. Thiel. David Clements seconded the motion. The motion carried 3-0.
