Regular Town Board Meeting

September 14, 2015

Chairman Darrel Fehr called the meeting to order on September 14, 2015 at 7:30 pm.   The supervisors present were David Clements and Matt Borofka-7:40 pm.   Other officers present were:  Victoria Trinko-clerk and Judith A. Prince-treasurer.  See attached attendance sheet.
Certification of proper posting for the scheduled town board meeting: The notice for the September town board meeting was duly posted on September 10, 2015 in the 3 designated places within the Town of Cooks Valley. 
Public Comment:  Calvin Swartz inquired about the procedure to change the hour of recycling on Saturday to 7:00-11:00 am instead of 8:00-12:00.  This item will be placed on the October agenda.  Marvin Topper, at Danny Emerton’s daughter’s request, designed a guide for the Cooks Valley cemetery and framed it to be placed at the Cooks Valley Town Hall.  This guide was brought to the town hall by Harry Prince, custodian of the Town of Cooks Valley cemetery.  Harry Prince will work with Marvin Topper on how to place this guide on the Town of Cooks Valley website and/or send it to the town clerk to place on the website.  There was a suggestion to send a thank you to Marvin Topper.  Gene Pagel commented Monarch Paving Company did a great job on the paving of 60th Street. 
Discussion and possible action on budget categories:  no action was needed.
Approval of the August 17, 2015 regular monthly town board meeting minutes:  David Clements made a motion to approve and place on file the August 17, 2015 regular monthly town board meeting minutes.  Darrel Fehr seconded the motion.  The motion carried 2-0. 
Reading by the Treasurer of the August financial report:  The ending check book balance was $231,052.05 as of August 31, 2015.  The total cash assets for the Town of Cooks Valley were $446,655.84.  
Reading and approval of the August bills:  David Clements made a motion to approve payment of the August bills.  Darrel Fehr seconded the motion.  The motion carried 3-0.  
Building permits:  no building permits issued.
Discussion and possible action pertaining to the plan commission:  Doug Zwiefelhofer, plan commission chairman, conducted a plan commission meeting on August 26, 2015 to address the request of a variance by Stacy Pecha.  Kyle Warner will be building a house on a parcel of land owned by Stacy Pecha.  During the public hearing and the meeting, the 5 acre lot size requirement was noted to have been grandfathered in.  Stacy Pecha requested the variance, but Kyle Warner is the individual who needs it.  She would like the variance approved prior to transfer of deed.  Another concern was the actual property line was not surveyed.  John Pecha measured the feet to make an acre.  John Pecha appeared prior to the meeting and wanted to know what he had to sign to approve the request but when informed he did not have to sign anything he left the meeting without signing the attendance sheet.  His comment was he just didn’t want her building on his land.  The legal definition of the deed was in compliance with the distance from the center line.  Stacy Pecha wants the house to line up with garage that is 40 ft. from the property line.  The plan commission recommends the approval of the request for a variance of 40 ft.  from the existing east property line contingent upon the transfer of title from Stacy Pecha to Kyle Warner.  Kyle Warner was present at the meeting but did not sign the attendance sheet.   David Clements made a motion to approve the variance of 40 ft.  from the existing east property line contingent upon the transfer of title of the parcel from Stacy Pecha to Kyle Warner.  Matt Borofka seconded the motion.  The motion carried 3-0.
Discussion and possible approval on brushing in the Town of Cooks Valley:  Chairman Darrel Fehr received bids from Jason Rihn-J&J Clearing and Makovsky Brushing for brushing in the Town of Cooks Valley.  David Clements made a motion to award the contract for brushing in the Town of Cooks Valley to J&J Clearing, not to exceed $5000.00.  Darrel Fehr seconded the motion.  The motion carried 3-0. 
Discussion and possible approval of Humane Society contract:  Darrel Fehr made a motion to accept the Humane Society contract for 2016.  David Clements seconded the motion.  The motion carried 3-0. 
Discussion and possible action on shouldering of 60th Street and 186th Avenue:  The shouldering is washing out on 60th Street between County Highway A and State Highway 40.  Darrel Fehr will place cones along the side of the road and request Chippewa County Highway Dept. to place asphalt on the shoulder of the road where the water is washing over the road.   Asphalt been installed on the road before the new paving of 60th Street.  Truck traffic has blown the shouldering on 186th Avenue.  Darrel Fehr made a motion to reshoulder 186th Avenue on the west end at the change of pavement at the mine entrance east to 60th Street.  David Clements seconded the motion.   The motion carried 3-0.
Chairman’s report – Fire Dept. –no fire calls in August for the Town of Cooks Valley- The chairman received the bridge inspection report complete with pictures and all the bridges are okay in the Town of Cooks Valley.  The Town of Cooks Valley needs to pay the bill for the bridge inspection.  Mine roads- 186th Avenue –Don Prill’s driveway should have a culvert and Chippewa County highway Dept. is not going to install it.  The engineer and the county approve the project completion and Antczak has the retainage.  Signs need to be placed.  It is a nice road and they are washing and sweeping the sand off the road.
Dissemination of Information-Clerk’s report:  There will be an increase in WTA dues in 2016.  Booklets were received from the Heartland Institute on the environment impacts of frack mining. 
Future agenda items and business:
Discussion and possible action on budget categories, Building permits, on concerns pertaining to the Plan commission,  recycling hours,  Chairman’s report, Dissemination of information, future agenda items and business. Next regular board meeting will be October 19, 2015 at 7:30 p.m. [note one week later].  Annual permit review of Preferred Sands and Chippewa Sands on September 21, 2015.
Adjourn:  Darrel Fehr made a motion to adjourn at 8:25 pm.  David Clements seconded the motion.  The motion carried 3-0.
