Chairman Darrel Fehr called the meeting to order on September 15, 2014 at 8:21 pm. The supervisor present was John Sykora. Other officers present were: Victoria Trinko-Clerk and Judith A. Prince-treasurer. See the attached list for delegation present.
Certification of proper posting for the scheduled town board meeting: The notice for the September town board meeting was duly posted on September 9, 2014 in the 3 designated places within the Town of Cooks Valley.
Public Comment: Mark Berge shared pictures of the junction of Running Valley Creek and 18 Mile Creek. The branch of Running Valley Creek is clear and the flow from 18 Mile Creek is milky coming from the EOG mine site [Denny Schindler’s property] which then flows down to Colfax and onto the Red Cedar and Tainter Lake. This is a registered trout stream. DNR fishery personnel were present today shocking for fish in the creek but did not find any fish and this would also affect the eggs of fish. It was expressed that the Governor of Wisconsin and the legislature are not regulating these mines with the stringency that is needed. Jim Devlin of the DNR had known about the milky, silt flow from the previous week but had not informed the personnel from the fishery dept. Ken Schmitt informed the group of an informational meeting on September 18 at the Howard Town Hall and the opportunity to sign a petition to be presented to the Natural Resources Board to direct the Wisconsin DNR to conduct a strategic analysis of the frack sand mining industry in regards to the affects of on health, environment, and economic impacts.
Discussion and possible action on budget categories: Darrel Fehr made a motion to move $200.00 from non-allocated funds to B-073 printing and publication, leaving an amount of $8200.00 in non-allocated funds. John Sykora seconded the motion. The motion carried 2-0
Approval of the August 18, 2014 regular monthly town board meeting minutes: John Sykora made a motion to approve and place on file the August 18, 2014 regular monthly town board meeting. Darrel Fehr seconded the motion. The motion carried 2-0.
Reading by the Treasurer of the August financial report: The ending check book balance was $141,104.42 as of August 31, 2014. The total cash assets for the Town of Cooks Valley were $313,513.16. There were six outstanding checks.
Reading and approval of the August bills: John Sykora made a motion to approve payment of the August bills. Darrel Fehr seconded the motion. The motion carried 2-0.
Building permits: Dean Rosenbrook-hay storage shed, Andrew Shakal-shelter for firewood, Robby Turner-shed, Duane Shoebridge-addition to existing home, Joe Babbitt-hay shed, Carol Clements-garage, Kristen Clements-garage, Chris Lang & Courtney Bungartz-pole shed, Jim Kleingartner-remodeling bathroom, entry, stage.
Discussion and possible action of concerns pertaining to the plan commission: no action was needed.
Discussion and possible approval on cigarette operators license applications: Darrel Fehr made a motion to approve the operators license applications. John Sykora seconded the motion. The motion carried 2-0.
Discussion and possible action on 60th Street flexpatch warranty work by Fahrner: Due to the winter weather of last year, more cracks have appeared in the town roads. Fahrner has done one year for free on the cracks on 60th Street and are asking the Town of Cooks Valley to pay 1/3 of the weather related warranty this year. Darrel Fehr made a motion to pay 1/3 of the warranty of $1500.00 for flexpatching on 60th Street. John Sykora seconded the motion. The motion carried 2-0.
Discussion of future mine sites: Chairman Darrel Fehr contacted the Town of Cooks Valley lawyer, Glenn Stoddard, who advised the town would have to follow the ordinance of going through the plan commission, then to the town board, basically follow the process regarding safety issues, air monitoring, and water run off.
Chairman’s report – Fire Dept.-no fires were reported in the Town of Cooks Valley in the month of August. Mine Road-the 186th Avenue road construction is slowly progressing. The road is very torn up creating difficulty for local traffic. There is a possible use of the alternate route to 60th Street on Thursday the 18th.
Dissemination of Information- clerk’s report –received the Humane Association contract, on Nov. 17, 2014 the DOR will direct deposit $33,865.00 into the Town of Cooks Valley checking acct., the DOR estimate for 2015 shared revenue is the same as 2014.
