TOWN OF COOKS VALLEY
SPECIAL TOWN BOARD MEETING

January 13, 2016

The Special Town Board meeting of the Town of Cooks Valley was called to order on January 13, 2016 at the Cooks Valley town hall located at 15751 40th Street at 6:30 pm by Chairman Darrel Fehr.  Supervisors present were David Clements and Matt Borofka.  Other town official present was Victoria Trinko-clerk. 
Discussion on permit and permitting process for PurFrac Sand:  There was a discussion of the forms the Town of Cooks Valley requires in the permitting process.  PurFrac must fill out the permit with specific information regarding their operation.   It was reported there would be no blasting, no dredging, just digging.  PurFrac has a contract for sand.  There would be a dry plant located in New Auburn with an existing rail permit, but no definitive time line.  Road agreements need to be in place prior to the application.  There are two road agreements: road maintenance and road right-of-way.  The road and road access has to undergo a study with an evaluation and rating of 1-10.  Resolutions have to be agreed up with EOG, Don Sarauer, and Louis Sonnentag.  PurFrac indicated they would pay into a kitty using rates of per ton/per mile.  They would operate 10 feet above the water table and estimate 100 loads a day.  There would be holding ponds:  some lined and others unlined to allow water to dissipate.  Summit/Cooper is working with the wells.  The application is filled out but the public hearing is not scheduled.  PurFrac intends to contact Dan Fedderly in regards to the road evaluation and resolution of road agreements at a percentage rate for the road evaluations.  A tentative startup is spring of 2016.  Buck Sweeney, Purfrac’s attorney, is associated with the Axley firm, located in the Madison area.
Adjourn: David Clements made a motion to adjourn the meeting at 7:31 pm.  Darrel Fehr seconded the motion.  The motion carried 3-0.
