The Special Town Board meeting of the Town of Cooks Valley was called to order on July 19, 2012 at the Cooks Valley town hall located at 15784 40th Street at 8:43 pm by Chairman Darrel Fehr. Supervisors present were David Clements and John Sykora. Other town official present was Victoria Trinko-clerk.
Discuss the public hearing testimony, the permit application, and any proposed changes and/or additional conditions, and may vote on whether to approve, deny, or approve with modifications the proposed permit of Preferred Sands of Minnesota LLC: Attorney Glenn Stoddard would like to have the comments from the public hearing, Preferred Sands comments and the board’s comments. Then he will talk to the Preferred Sands’ lawyers and redo the town proposal. He and the board hope to have a close agreement before the next meeting.
Some comments by the board about the proposal-David Clements would like to see a review of the permit every 5 years after the first 5 year annual reviews of the permit. The ‘timely manner’ for action on the part of the mining company on complaints would be changed to ‘within 10 days’, a bond on section 5.3, and an increase of time for well replacement after reclamation. The noise language is duplicated and Glenn Stoddard will remove the section that is not as quiet- section 2.11 noise of trucks.
The board would like the hours of operation addressed; exempt hours of trucking operation while school busses are in operation be added; possible enactment of an ordinance for fees and mining permit fee schedule.
There was discussion of noise monitoring at a residence that may be done by the resident owner and the resident owner may ask for noise monitoring by the mining company which may result in the mining company reducing the noise level.
There was discussion on the length of three years of inactivity with a possible definition of inactivity and reduction to two years of inactivity at the mine site.
Adjourn: David Clements made a motion to adjourn the meeting at 9:29 pm. John Sykora seconded the motion. The motion carried 3-0.
