TOWN OF COOKS VALLEY
Special Town Board Meeting
June 4, 2020

The Special Town Board meeting of the Town of Cooks Valley was called to order on Thursday, June 4, 2020 at the Cooks Valley town hall located at 15751 40th Street at 7:30 pm by Chairman Darrel Fehr. Supervisors present were David Clements and Matt Borofka.  Other town officials present were Town Clerk Vicki Freeberg.

Review of EOG non-metallic mining permit with public comment:
Dave Bokor, representative for EOG, gave an overview of the year and production of the EOG DS mine.  The mine was operational April 15 to August, 2019 with 225,451 tons of raw frack sand hauled out and 72,600 ton of waste sand hauled back. No sand was extracted from the SS mine for the months of November 2019 through April 2020.
They have no plans to mine in the DS or SS mine for the year 2020 unless there would be a drastic change in the markets.
There remains a skeleton crew at the mine from Kramer Mining. The mines are required to manage existing wetland area per WDNR requirements, improvements will allow to control and minimize discharge while maintaining quality of water. They have adopted a more stringent plan than required which meets or exceeds the state regulations. EOG will continue to monitor these three ponds during the 2020 year.
David Clements asked if there were any plans for reclamation and Dave Bokor commented that there was no plans as of now.
PURFRAC & EOG road agreement discussion:
Dave Rosenbrook told board that the road agreement was still holding up plans to start mining. No time frame has been set as yet. Dave Bokor shared concerns that EOG was hesitant to sign agreement after the board proposed amendment. The Amendment would release Township from any financial responsibility if Purfrac were to be sued by EOG for damage to road which would stop EOG’s normal production. EOG would like a 90 day pause to see what the markets are going to do and would also like to see a letter of intent to mine from the DNR. Darrel Fehr also raised concerns on the road and upkeep to be done. Dave Bokor will check with engineers to get opinion.
Darrel Fehr made a motion to table this discussion until the end of August and board will meet again to see where the agreement stands. Matt Borofka seconded the motion.  The motion carried 3-0.
 
A motion to adjourn was made by Darrel Fehr at 8:19 pm.  Matt Borofka seconded the motion.  The motion carried 3-0.
