TOWN OF COOKS VALLEY
SPECIAL TOWN BOARD MEETING

May 18, 2011

          The Special Town Board meeting of the Town of Cooks Valley was called to order on May 18, 2011 at the David Clements’ residence located at 13910 60th Street  12:30 pm by Chairman Darrel Fehr.  Supervisors present were David Clements and John Sykora-1:17 pm.  Other town official present was Victoria Trinko-clerk.  Others present:   Vanessa Klemish representing Preferred Sands, Paul McLean –Vice President of Corporate Development, Scott Jensen-attorney representing Preferred Sands [both via speaker phone], Glenn Stoddard 12:52 pm, Attorney for Town of Cooks Valley, and Carol Clements.         
Discussion of road use agreement:

• Bond vs. escrow
• Spring weight restrictions not being used as a preventative measure to stop hauling sand
• Payment into escrow
• The amount of payment into escrow
• .06 of payment per ton/per mile to be used at the discretion of the town board
• Days and hours of operation
• Tarping of trucks
• Cleaning up of spills
• Third party doing industrial hauling
• Alternate routes
• Termination conditions
• Communication between Town of Cooks Valley & Preferred Sands

Adjourn:  David Clements made a motion to adjourn at 3:14 pm.  John Sykora seconded the motion.  The motion carried 3-0.
