The Special Town Board meeting of the Town of Cooks Valley was called to order at 9:50 pm on Wednesday October 16, 2013 at the Cooks Valley town hall located at 15784 40th Street by Supervisor David Clements. Supervisor present was John Sykora. Other town officials present were Darrel Fehr-chairman [who recused himself] and Victoria Trinko-clerk.
Discussion and possible action on Chippewa Sands LLC application/permit for non-metallic mining:
There was discussion of section 11.7 as to the inclusion of ‘in accordance with exhibit B or Glenn Stoddard’s version or Chippewa Sands version. Chippewa Sands stood firm on their version with the exclusion of the extended version. The proposed section 11.7 will read Right to Require New or Modified Permit for Expansion of Mining Operations in accordance with Exhibit B, the Town reserves the right to require Permit Holder to apply for a new or modified Permit if it proposes to expand its mining operations to encompass land that is not currently subject to Permit Holder’s reclamation permit
John Sykora made a motion to approve the non-metallic mining permit between Chippewa Sands LLC and the Town of Cooks Valley with the changes to section 3.4 clerk’s mailing address, and section 11.7. David Clements seconded the motion. Roll call vote: David Clements-yes, John Sykora-yes. The motion carried 2-0.
